TERMS AND CONDITIONS LANDSZO VENTURES (OPC) PRIVATE LIMITED

The user is visiting LANDSZO VENTURES (OPC) PRIVATE LIMITED ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") apply to the userr visit, access, and use of our website, mobile applications, and other digital platforms (collectively, the "Platform"). By visiting or using our Platform, the user understand that the user have read, understood, and agree to be legally bound by these Terms. If the user do not accept any aspect of these Terms, the user must cease using our Platform and services immediately.

  1. Purpose of the Platform

The Platform is aimed at serving as a technology-driven intermediary service provider. Its main purpose is to simplify and digitalize the property management environment through the application of online tools and advanced technology. We empower buyers, sellers, developers, brokers, and investors to interact on one online platform accessible both in India and internationally. Our services allow users to access verified property listings, detailed details, locality details, builder feedback, and price comparisons. The Platform additionally offers sophisticated functionalities like AI and natural language processing (NLP) facilitated property searches, automated customer care, market insights, virtual property walk-throughs, 3D visualization, and AR/VR-based interactions. We also enable digital marketing and branding service solutions for real estate developers, brokers, and professionals, with optional integrations of smart home technology subject to third-party assistance and availability.

Note: The Platform only operates as an information medium and facilitator of technology. We are not an agent, broker, or developer. We do not perform background verification of claims of ownership, nor do we warrant the accuracy, authenticity, or legal validity of third-party listings. The onus to verify every aspect of a property, including ownership, compliance with law, and authenticity of information, is with the users alone.

  1. Eligibility

In order to use our Platform, the user should be no less than 18 years old and of sound legal capacity to enter into legally binding contracts. When creating an account, the user represent that all information provided by the user, including name, contact details, and ownership or authorization information in relation to the properties listed, is accurate, complete, and true. If the user is a developer, agent, or business entity, the user shall be liable to comply with all the relevant laws as mandated by the Real Estate (Regulation and Development) Act, 2016 (RERA), Goods and Services Tax (GST), local registration rules, and stamp duty rules and any other law for the time being in force. The Company reserves the right to terminate or suspend any account in case the eligibility criteria are not fulfilled or where false or deceptive information is found.

  1. User Responsibilities

By accessing and using our Platform, the user acknowledges and agree to conduct the user self in good faith and to utilize our services for legitimate purposes only. The user is also liable for ensuring that property information and content offered by the user are accurate and not false or misleading, fraudulent, or libelous. The user are required to have due respect for the intellectual property rights of the Company and third parties and not seek to copy, reverse-engineer, or otherwise exploit the technology and content on our Platform. The user is not permitted to upload any material with viruses, malware, or damaging code. Additionally, the user is obligated to keep the user login credentials confidential and notify us at once should the user believe that there has been unauthorized use of the user’s account.

  1. Property Listings and Transactions

We provide property information such as price, availability, ownership, and location from third parties like sellers, brokers, or developers. We do not independently verify these details and so cannot guarantee their correctness. Users are cautioned in the strongest terms to conduct their own diligence and consult professional advisors prior to entering into a transaction. We assume no responsibility for the completion, cancellation or failure of any property transaction or for disputes arising between buyers, sellers, brokers or developers. The Company assumes no liability for fraud, misrepresentation, financial losses or legal disagreements which may arise between third-party users.

  1. Use of Technology and Data

The Platform uses technologies like Artificial Intelligence, Natural Language Processing, and Large Language Models to make property recommendations, insights, and analytics. Although we do our best to offer helpful and accurate information, such outputs are created by automatic systems and therefore must not be regarded as professional guidance. All user data obtained is processed in accordance with our Privacy Policy and Cookie Policy, which conform to the provisions of the Digital Personal Data Protection Act, 2023. Users understand that errors, delays, and inaccuracies can happen from time to time owing to technological constraints, and the Company shall not be held responsible for any such results.

  1. Virtual Tours and Smart Home Integrations

The Platform provides services like 3D walkthroughs, AR/VR experiences, and other visual content. Such virtual representation, however, may not always be consistent with the true state of a property. Smart home integrations provided by the Platform are subject to third-party systems, and we disclaim responsibility for device failure, technical failure, unauthorized access, or hacking of these systems. Users must personally verify the condition and suitability of any property or technology before making financial or contractual commitments.

  1. Property Listing on Website

The Company provides a platform for developers, brokers, and agents to list their properties on our website. Our role is limited to displaying the property details as provided by the respective users. We do not guarantee inquiries, leads, sales, or conversions. All property information displayed is based on the data shared by the property owners or their authorized representatives, and the Company is not responsible for any inaccuracies or misrepresentations.

  1. Intellectual Property

All intellectual property such as but not limited to logos, designs, branding, content, AI tools, software, and technology employed on the Platform belongs to the Company exclusively. Users will not copy, reproduce, modify, or distribute any content of the Platform without our written consent first. Illegal use of our intellectual property will attract legal action.

  1. Limitation of Liability

The Company is merely a technology intermediary and does not, in any manner, represent itself as a real estate developer, agent, or broker. We do not provide any warranties of property ownership, compliance with the law, returns on finances, or investment results. To the extent permitted by law, we disclaim any responsibility for any direct, indirect, incidental, or consequential damages, including but not limited to business opportunities, loss of profits, data, or goodwill. We are not responsible for fraudulent activity, misrepresentations, or defaults by third-party users of the Platform.

  1. Refund and Cancellation and Payment Gateway Policy

Any payments received on the Platform, such as but not limited to subscription fees, advertisement charges, promotion services, and any other payment related to services, are absolutely non-refundable in any situation whatsoever. As soon as the payment is made, users will not be eligible to receive a refund, reversal, or credit for any reason at all, such as dissatisfaction with services, user's cancellation of services, or non-use of purchased services.

The Platform makes payments with authorized third-party payment gateways such as PhonePe and other established providers. By deciding to make payments through such gateways, the users consent to adhere to the terms, conditions, and privacy policies of said third-party payment processors. While we undertake the integration of secure and reputed payment gateways, the Company will not be responsible for any mistakes, technical issues, delays, declined transactions, chargebacks, or unauthorized transactions that might happen on behalf of the payment gateway or the bank of the user, card issuer, or financial institution.

Users are instructed to maintain transaction proof and review their account statements to ensure successful payment completion. If the payment fails or has been debited in error, users need to approach the respective bank directly or file a complaint with PhonePe (or the relevant payment gateway operator). The Company has no role in assisting beyond offering a platform for initiating payments and has no role in getting involved in disputes between the user and the payment gateway provider.

Users can opt to stop or terminate their subscription or services at any moment; nevertheless, said termination shall not qualify them for any refund of the paid amount. Through the use of the Platform and purchasing the services, you take on and agree with this no-refund and payment gateway policy in its entirety.

  1. Account Deletion and Data Retention

Users can ask us to delete their account by reaching out to our support staff. When we receive such a request, we will delete the account or anonymise or destroy personal data wherever it is possible. Nevertheless, some data might have to be kept up to the extent of compliance with applicable law or for legitimate reasons like resolution of disputes, prevention of fraud, or enforcement of legal rights. Any data we retain will continue to be processed in line with our Privacy Policy.

  1. User-Generated Content and Responsibility

Users can submit property postings, reviews, comments, or other information on the Platform. The user is entirely responsible for ensuring the accuracy, legality, and reliability of such information. By submitting information, the user automatically grants the Company a non-exclusive license to use, display, and distribute such information for the operation of the Platform. The Company has the right to remove any information that is false, defamatory, offensive, unlawful, or in breach of these Terms.

  1. Indemnity

The user indemnifies and holds the Company, its officers, directors, employees, and affiliates harmless from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising out of the user’s use of the Platform, the user’s breach of these Terms, or any dispute with respect to the user’s transactions with other users.

  1. Force Majeure

The Company will not be held responsible for failure or delay in service delivery due to events outside our reasonable control. Some examples of these events include natural disasters, government actions, strikes, labor disputes, network outages, cyberattacks, technical malfunctions, pandemics, or other circumstances that render performance impossible or impracticable.

  1. Terms Amendments

We may change, amend, or update these Terms at any time without notice. Any updates will be published on the Platform, and the "Last Updated" date will be updated accordingly. The userr continued use of the Platform after any such change will be an indication of the userr acceptance of the changed Terms.

  1. Disclaimer and Warranties

The Platform and all services, features, and content made available on or through it are made available on an "as is" and "as available" basis, without any warranties of any kind, express, implied, or statutory. The Company disclaims all warranties, representations, and conditions, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, availability, non-infringement, or that the Platform will be uninterrupted, error-free, virus-free, or that it will be free of any harmful components.

We make no representation or warranty as to:

  1. The legality, accuracy, or reliability of property listings, user posts, or third-party information presented on the Platform.
  2. Results of property transactions, negotiations, or business opportunities realized through the Platform.
  3. The quality, security, or ongoing existence of third-party services, such as but not restricted to payment gateways (e.g., PhonePe), smart home integrations, or marketing campaign providers.
  4. By accessing and using the Platform, you agree and understand that your access to and use of the services are at your own risk. Any use of information, property listings, analytics, or digital tools available through the Platform is at your own risk and discretion, and the Company shall not be responsible for any losses or damages which may result from such.
  1. Disclaimer on Professional Advice

The Platform offers general information, data analysis, and property information for informational purposes only. Nothing on the Platform is to be interpreted as professional real estate, law, tax, or investment advice. Users are invited to seek advice from competent professionals including lawyers, financial advisers, or property consultants prior to taking decisions based on information made available through the Platform.

  1. Marketing Communication and Opt-Out

By signing up or using the Platform, the user agree to receive promotional messages, newsletters, and updates from the Company by email, SMS, or other means. The user can opt out of marketing communications at any time by following the directions in the message or by contacting our support staff. Nevertheless, the user can continue to receive service-related notifications that are essential for proper account functioning.

  1. Grievance Redressal

Pursuant to the Information Technology Act, 2000, and Digital Personal Data Protection Act, 2023, we have nominated a Grievance Officer to redress user grievances. Complaints, issues, or disputes can be directed to the Grievance Officer at:

The Grievance Officer shall accept complaints within forty-eight (48) hours of receipt and shall endeavour to resolve the dispute to the best of their abilities within thirty (30) days, as per applicable law.

  1. Termination of Use

We have the right to suspend, block, or permanently cancel any account whenever we discover that a user has disobeyed these Terms, provided false information, spammed other customers, or conducted unlawful, unethical, or harmful behavior. Cancellation may be done without a warning notice, and the Company is not liable for any loss or damage resulting from cancellation.

  1. Governing Law and Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of India. Any disputes arising out of the use of the Platform fall within the sole jurisdiction of the courts at Gurugram, Haryana. Users undertake to make an effort to settle disputes peaceably prior to seeking legal recourse.
